FlexFit Coaching Membership Agreement

1. Introduction

Welcome to FlexFit Coaching.

FlexFit Coaching is operated by Garrett Waller LLC, based in Arlington, Virginia.

By purchasing or subscribing to a FlexFit Coaching membership, program, or service, you agree to the terms outlined in this Membership Agreement.

These terms apply to all FlexFit services including:

• Personal training
• Online coaching
• Hybrid coaching memberships
• Workout programming
• Fitness guidance and accountability

By completing your subscription and accepting these terms, you confirm that you have read, understood, and agree to abide by this agreement.


2. Membership Services

FlexFit Coaching provides professional fitness coaching designed to improve strength, health, performance, and overall wellbeing.

Depending on the membership tier selected, services may include:

• Personal training sessions
• Online coaching and accountability
• Customized workout programming
• Training plans delivered through coaching apps
• Fitness education and guidance
• Progress tracking and feedback

The specific services included will depend on the membership plan selected at checkout.

FlexFit Coaching reserves the right to update or improve services, coaching systems, or delivery platforms in order to provide the best possible client experience.


3. Automatic Billing and Subscription Terms

FlexFit memberships operate on a recurring subscription basis.

By subscribing, you authorize Garrett Waller LLC to automatically charge your payment method for your membership fees.

Important billing details:

• Memberships renew automatically each month
• Billing occurs on the same calendar date as your original signup date
• Payments are processed securely through Stripe
• Payment methods may include credit card, debit card, or ACH bank debit
• Receipts are automatically emailed after each successful payment

If your billing date does not exist in a given month (for example the 31st), billing will occur on the closest available date.

Your membership will continue renewing automatically unless canceled according to the cancellation policy below.


4. Minimum Membership Commitment

FlexFit memberships require an initial 3-month commitment.

By subscribing, you agree to maintain your membership for a minimum of three billing cycles.

After the initial commitment period is completed, your membership will continue on a month-to-month basis until cancelled.

If a client chooses to stop services before completing the minimum commitment, the remaining balance of the commitment period may still be due.


5. Cancellation Policy

Clients may cancel their membership after the initial commitment period.

To cancel a membership:

• A cancellation request must be submitted in writing
• Cancellation must be requested at least 7 days before the next billing date

Cancellation requests submitted after this window may apply to the following billing cycle.

Once canceled, your membership will remain active until the end of the final paid billing period.

FlexFit Coaching does not process retroactive cancellations.


6. Session Scheduling and Cancellation

For memberships that include live personal training sessions:

Sessions must be scheduled through the approved scheduling system.

FlexFit Coaching maintains a 24-hour cancellation policy.

If a session is canceled with less than 24 hours notice, the session may be deducted from your membership.

FlexFit Coaching will make reasonable efforts to accommodate schedule changes when possible, but availability cannot be guaranteed.

Unused sessions may expire depending on the structure of your membership.


7. Payment Failure Policy

If a payment fails due to insufficient funds, expired payment methods, or other billing issues:

• The system will automatically retry the payment
• You may be asked to update your payment method

During unresolved billing issues:

• Membership services may be paused
• Scheduled sessions may be canceled
• Coaching access may be temporarily suspended

Services will resume once billing is successfully resolved.


8. Refund Policy

Due to the nature of coaching services and reserved training time:

All membership payments are non-refundable once billing has processed.

This includes:

• Coaching services delivered
• Reserved training sessions
• Access to programs or coaching platforms

FlexFit Coaching does not guarantee specific results related to weight loss, fitness, or health outcomes.

Refund exceptions may be granted at the sole discretion of Garrett Waller LLC.


9. Health and Fitness Disclaimer

Exercise and physical training involve inherent risks.

By participating in FlexFit Coaching services, you acknowledge that:

• You voluntarily participate in exercise and fitness activities
• You assume all risks associated with physical activity
• You are responsible for monitoring your own physical condition

Clients are encouraged to consult with a physician before beginning any exercise program.

FlexFit Coaching and Garrett Waller LLC are not responsible for injuries or health conditions resulting from participation in training or exercise programs.


10. Assumption of Risk and Liability Waiver

By participating in FlexFit Coaching services, you acknowledge and accept the inherent risks associated with physical exercise and training.

You agree that Garrett Waller LLC, FlexFit Coaching, and its trainers shall not be held liable for injuries, damages, or losses arising from participation in training programs except where required by law.

Participation in any exercise program is voluntary and undertaken at your own risk.


11. Billing Disputes and Chargebacks

If you experience a billing concern, we ask that you contact FlexFit Coaching directly so we can resolve the issue quickly.

By agreeing to these terms, you agree to make a good-faith effort to contact FlexFit Coaching before initiating a payment dispute or chargeback with your bank.

Most billing issues can be resolved quickly through direct communication.


12. Client Communication Expectations

Coaching results depend on consistent participation and communication.

Clients are encouraged to:

• Attend scheduled sessions
• Follow coaching guidance
• Communicate scheduling or health concerns
• Participate actively in their program

FlexFit Coaching provides guidance and accountability but cannot guarantee specific results.


13. Changes to Terms

FlexFit Coaching may update this Membership Agreement periodically to reflect changes in services or business operations.

Clients will be notified of significant updates.

Continued participation in services after updates constitutes acceptance of the revised terms.


14. Governing Law

This agreement is governed by the laws of the Commonwealth of Virginia.

Any disputes arising from this agreement will be handled in the appropriate courts located in Virginia.
